Exit strategies

If you are looking to exit a business, our solicitors can advise you on the best strategy for your circumstances, helping you reach a resolution. 

You may want to exit because you have found a better opportunity, or your employment relationship is breaking down. 

Your employer could be eroding your role, you might be suffering bullying by a manager or being discriminated against, you might have been placed on an unjustified performance plan, or you could, for instance, be being overlooked for promotion. 

Whatever the situation, we will guide you through the options, choose the best exit strategy and support you throughout.

In some situations, it may be appropriate to raise a grievance and or consider resigning and bringing a constructive dismissal claim. You should always seek legal advice at the earliest opportunity and before taking any decision to resign. There may be other claims to consider, too, depending on the circumstances and our solicitors will take every aspect into consideration.

While pursuing a grievance and / or claim could be appropriate in certain cases, we often find that it is worth exploring the possibility of reaching an exit deal with your employer at an early stage, rather than going through a lengthy and costly process. We have considerable experience in negotiating exit packages. We will assess the financial value of your case and then work to secure the most favourable outcome for you. 

When you reach an exit deal you will usually be required to enter into a settlement agreement with your employer. It is a requirement for you to seek independent legal advice on the terms and effect of the agreement and in particular its effect on your ability to pursue claims in the Employment Tribunal. We can advise you on the settlement agreement and the financial package as well as any appropriate terms that should be included. Issues to consider may include references, internal and external announcements, restrictive covenants, confidentiality and gardening leave. Find out more about our service here.
